TERMS OF SERVICE

1. AGREEMENT TO TERMS

By accessing or using MyObra ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

MyObra is operated by MyObra Inc., a Delaware corporation ("we," "us," or "our"). These Terms apply to all users of the App, including contractors and any customers who access shared links, estimates, or invoices.

2. WHO CAN USE MYOBRA

You must be at least 18 years old and capable of entering into a binding contract to use MyObra. By using the App, you represent that you meet these requirements.

MyObra is intended for use by independent contractors and small service businesses. You agree to use the App only for lawful business purposes.

The app is a tool for organizing and managing your service work. We are not responsible for verifying that users operate a licensed or registered business. You are solely responsible for complying with any local, state, or federal requirements applicable to your trade or service, including licensing, permits, taxes, and insurance.

3. ACCOUNT REGISTRATION

To access MyObra, you must create an account. You agree to:

  • Provide accurate and complete information during registration
  • Keep your account credentials secure and confidential
  • Notify us immediately at hello@myobra.io if you suspect unauthorized access
  • Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. SUBSCRIPTION AND BILLING

MyObra is a paid subscription service. Current pricing is displayed at myobra.io and within the App at the time of sign-up.

  • Free trial: New accounts receive a 14-day free trial. No payment is required during the trial period.
  • Billing: After your trial ends, your subscription will automatically renew monthly unless canceled.
  • Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. No refunds are issued for partial months.
  • Price changes: We may change subscription pricing with at least 30 days' notice. Continued use after a price change constitutes acceptance of the new price.

All billing is handled by Stripe. By subscribing, you agree to Stripe's terms of service at stripe.com/legal.

5. ACCEPTABLE USE

You agree not to use MyObra to:

  • Violate any applicable law or regulation
  • Infringe on the intellectual property rights of others
  • Upload, transmit, or store any content that is obscene, offensive, or inappropriate, including explicit imagery or hate speech
  • Upload or transmit malicious code, viruses, or harmful content
  • Attempt to probe, scan, or test the vulnerability of the App or circumvent any security measures
  • Deliberately attempt to cause errors, crashes, or unintended behavior in the App
  • Use the App in any way that could damage, disable, or impair our servers or infrastructure
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use the App for any purpose other than managing your own legitimate service business
  • Resell, sublicense, or otherwise transfer access to the App to third parties

6. YOUR CONTENT

MyObra allows you to create, upload, and store content including invoices, estimates, job photos, customer information, and signatures ("Your Content"). You retain full ownership of Your Content.

By using MyObra, you grant us a limited license to store, display, and process Your Content solely to provide the App's features to you. We do not sell or share Your Content with third parties.

You are solely responsible for the accuracy and legality of Your Content, including any estimates, invoices, or agreements you send to your customers.

7. CUSTOMER DATA

As a contractor using MyObra, you may store personal information about your customers (names, phone numbers, addresses, signatures). You agree to:

  • Collect and use customer data only for legitimate business purposes
  • Comply with all applicable privacy laws when handling customer data
  • Not use customer data for any purpose unrelated to your service business

8. SHARED LINKS AND SIGNATURES

MyObra allows you to generate shareable links for estimates and invoices that your customers can view, accept, decline, and sign. These links expire after 48 hours.

Electronic signatures collected through MyObra are intended to serve as a record of customer acceptance. MyObra provides the technical mechanism for collecting electronic signatures and is not a party to any agreement between you and your customers. We do not guarantee that signatures collected through the App will be legally enforceable in your jurisdiction, and we recommend consulting a legal professional if you have specific compliance requirements.

The E-SIGN Act (Electronic Signatures in Global and National Commerce Act) recognizes electronic signatures as legally valid in the United States. You are responsible for ensuring your use of electronic signatures complies with applicable laws in your jurisdiction.

9. INTELLECTUAL PROPERTY

MyObra, including its name, logo, design, and software, is owned by MyObra Inc. and protected by applicable intellectual property laws. These Terms do not grant you any rights to our intellectual property beyond the limited license to use the App during your subscription.

10. DISCLAIMERS

MyObra is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

  • The App will be uninterrupted, error-free, or completely secure
  • Any errors or defects will be corrected
  • The App will meet your specific business requirements

Your use of the App is at your own risk.

11. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, MyObra Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including but not limited to lost profits, lost data, or business interruption.

Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the three months preceding the claim.

12. INDEMNIFICATION

You agree to indemnify and hold harmless MyObra Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App, Your Content, or your violation of these Terms.

13. TERMINATION

We may suspend or terminate your account at any time if we believe you have violated these Terms or for any other reason at our discretion. You may terminate your account at any time by canceling your subscription and ceasing use of the App.

Upon termination, your right to access the App ends immediately. We may retain your data for a reasonable period as required by law or for legitimate business purposes before deletion.

14. CHANGES TO THESE TERMS

We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice in the App. Your continued use of MyObra after changes take effect constitutes your acceptance of the updated Terms.

15. GOVERNING LAW

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.
